THE ROLE OF THE COMMISSION FOR THE CONTROL OF INTERPOL'S FILES IN DATA PROTECTION
PERSONAL DATA PROTECTION ON A GLOBAL SCALE
The International Criminal Police Organization's activities in combating transnational and organized crime are directly linked to the mass processing of personal data at a global level.
It should be noted that INTERPOL, on the one hand, manages 19 databases, and on the other, through colour-coded notices and diffusions, disseminates personal data at lightning speed across the permanently operating I-24/7 global network, ensuring its circulation across up to 196 countries.
Where is the boundary between global security and the inviolability of personal data? – it is defined by Interpol's constitution and data processing rules (RPD), which limit the unauthorized processing of data.
In view of this, an independent body – the Commission for the Control of INTERPOL's Files (CCF) operates within the organisation's system, overseeing the lawfulness of the processing of personal data in INTERPOL's information system and, in this regard, examining applications submitted by data subjects.
HOW DOES INTERPOL PROCESS PERSONAL DATA ON A GLOBAL SCALE?

Identification of an unidentified body when its identity cannot be determined, which may assist in solving a possible crime or locating the deceased's family.

SILVER NOTICE
Tracing financial assets related to criminal activity at the international level (effective from January 10, 2025).

UNITED NATIONS SECURITY COUNCIL SPECIAL NOTICE
Implementation of United Nations Security Council sanctions against individuals financing, for example, terrorism (ISIS, Al-Qaeda, Taliban).
INTERNATIONAL WANTED STATUS THROUGH AN INTERPOL RED NOTICE
If an INTERPOL member country or the International Criminal Court decides to search for a fugitive at the international level, it applies to the General Secretariat through the INTERPOL National Central Bureau, requesting the issuance of a Red Notice.
From this moment on, the General Secretariat verifies the formal legal grounds for issuing a Red Notice and takes the corresponding decision.
In the case of a Red Notice being issued, the data of the wanted person is entered into Interpol's criminal information system and through the permanent I-24/7 communication network immediately begins circulating in 196 member countries.
WHAT ARE THE CONSEQUENCES OF A RED NOTICE?
CRITICAL ASPECTS OF INTERNATIONAL WANTED STATUS
Through a Red Notice, INTERPOL informs its 196 member countries that a particular person is wanted — someone subject to criminal prosecution or against whom a conviction has been handed down. A notice is generally accompanied by the following data: last known location, date of birth, photograph, biometric data and a brief description of the case. Accordingly, the issuance of a Red Notice gives rise to a number of legal difficulties, in particular:
RESTRICTION OF FREEDOM OF MOVEMENT
It becomes practically impossible for a wanted person to legally cross the air, sea or land border of any country, since their documents are checked against INTERPOL's databases at the border.
PROBLEMS WITH RESIDENCE STATUS
Airports, seaports and land border crossing points record every border crossing, which significantly facilitates tracking a wanted person.
DETENTION AND EXTRADITION
Finally, if a wanted person is located, they will be detained by the police and extradition proceedings will be initiated against them in accordance with national legislation and/or the Rome Statute.
GENERAL SECRETARIAT OF INTERPOL DOES NOT ISSUE A RED NOTICE IF THE REQUEST:
- IS POLITICALLY MOTIVATED;
- AIMS AT PERSECUTION ON RELIGIOUS GROUNDS;
- HAS A RACIAL BASIS;

THE CORE MISSION OF THE CCF
As noted above, the CCF is an independent body that verifies whether the processing of data by INTERPOL complies with the organisation's rules and data protection principles. It does not investigate the case, does not rule on the substance of the charges and does not take part in extradition proceedings. Its sole task is to check whether the processing of data meets INTERPOL's requirements.
